Social Security Disability Appeals Services

At Pinyerd Disability Law, LLC, we understand the challenges that come with applying for Social Security Disability benefits. Unfortunately, sometimes even the most deserving applicants are denied these benefits. But don't give up hope – our Social Security Disability Appeal Attorneys are here to help.

What Is a Social Security Disability Appeal?

If you have been denied Social Security Disability benefits, the next step is to start the appeals process. This involves requesting that the Social Security Administration (SSA) review your case again, and depending on whether you claim is approved or denied, you could go through several levels of appeals in order to get your benefits.

Here are the general steps in the appeals process:

  1. File the Request for Reconsideration (First Level of Appeal):

    • The first level of appeal is called a "Request for Reconsideration." To start this process, you will need to complete a "Request for Reconsideration" form or submit a written request within 60 days of receiving your denial letter.
    • You can provide additional medical evidence or documentation to support your claim during this stage. It's essential to address the reasons for the denial.
  2. Wait for the Reconsideration Decision: The SSA will review your case again, including any new evidence you've submitted. You will receive a decision letter that informs you of the outcome.

  3. Request a Hearing (Second Level of Appeal):

    • If your claim is denied again at the reconsideration stage, you have 60 days to request a hearing before an administrative law judge (ALJ).
    • During the hearing, you can present your case, provide additional evidence, and have witnesses testify on your behalf.
  4. Attend the Hearing: Attend the hearing in person or via video conference if necessary. Be honest, provide clear and concise answers, and follow your attorney's guidance.

  5. Wait for the ALJ's Decision: After the hearing, the ALJ will issue a written decision. If your claim is approved, you will receive benefits. If it is denied, you have further options.

  6. Request an Appeals Council Review (Third Level of Appeal):

    • If the ALJ denies your claim, you can request a review by the Social Security Appeals Council within 60 days.
    • The Appeals Council will either review your case, issue a decision, or send it back to the ALJ for further review.
  7. Federal Court Review (Fourth Level of Appeal):

    • If the Appeals Council denies your claim or declines to review it, you can file a lawsuit in federal court within 60 days of receiving their decision.

It's important to note that the appeals process can be lengthy and may take several months or even years to complete. Having proper documentation and legal representation can significantly improve your chances of a successful appeal.
