Indianapolis Supplemental Security Income Attorneys

Seasoned Legal Representation

Supplemental Security Income (SSI) provides monetary benefits to older and/or disabled Americans with limited resources. The program acts as a crucial lifeline to those who are unable to work for a year or more. Unfortunately, navigating the ins and outs of the program is rarely as easy or as straightforward as it should be.

If you are struggling to apply for SSI benefits or your claim has been wrongfully denied, our Indianapolis Supplemental Security Income lawyers can provide the legal support you need. We have over a decade of experience handling disability cases and have won millions for our clients. Our team at Pinyerd Disability Law, LLC knows how to effectively manage the bureaucracy of the Social Security Administration (SSA), and our attorneys will work directly with you to ensure your claim gets the attention it deserves.

Our firm has a strong track record of securing favorable results for our clients. Schedule an initial consultation by contacting us online or calling (317) 342-5991.

Who Qualifies for Supplemental Security Income in Indiana?

Not everyone with a disability will necessarily qualify for SSI funds. Applicants must meet certain criteria.

If you are 65 years of age or older, you do not necessarily need to be disabled to access SSI benefits in Indiana. If you are under the age of 65, you will only be eligible if you are either blind or are disabled. A disability will only qualify if a mental or physical medical condition prevents you from working for at least one year.

Additionally, an adult with a disabled child may be eligible for SSI benefits. All applicants must be United States citizens.

SSI benefits are need-based. Consequently, an applicant must also prove they do not exceed income or asset limits, regardless of their age or disability status. As of 2022, an individual applicant’s income limit is set at $19,560 annually in Indiana (if you are not retired). Income includes wages from jobs, pensions, Social Security benefits, long-term disability insurance benefits, and workers’ compensation funds.

An individual applicant also cannot hold more than $2,000 in assets at any one time. Assets include savings, retirement benefits, and real estate property (excluding your family residence). Your home and your personal property (including your jewelry, clothing, and furniture) are not considered countable assets for purposes of SSI eligibility.

Determining whether you qualify for SSI benefits can be a confusing and frustrating process. Our Indianapolis Supplemental Security Income (SSI) attorneys can carefully evaluate your circumstances and advise whether you are likely eligible.

What to Do When Your Supplemental Security Income Claim Is Denied

The SSA routinely denies many applications for benefits, sometimes for unclear or seemingly unjustified reasons. The government may claim you make too much money, your disability is not severe enough, or you did not provide enough evidence. No matter the reason for the denial, you have options for appealing the decision.

You should not face the SSI appeals process alone. Hiring qualified legal representation can significantly increase the odds of obtaining a favorable result.

You have the right to a second review of your denied SSI claim, and you will be able to submit additional evidence and documentation when making this request. Doing so can help you resolve the SSA’s stated issue(s) with your original application.

If your SSI claim is denied again, you can ask for a hearing with an administrative law judge. Witnesses can testify on your behalf at this hearing, and you will have another chance to present evidence that supports your program eligibility. If you receive an unfavorable ruling, you can still pursue an appeals council review.

Our Indianapolis supplemental security income lawyers are prepared to help regardless of where you are in the process of seeking benefits. Whether you have yet to submit an initial application or you are struggling to understand your appeals options, our team at Pinyerd Disability Law, LLC can offer clear and compassionate guidance. No situation is too complex for us, and we will do everything possible to advance your SSI claim.
