There are no charges for fees at the CAVC level because of a program called Equal Access to Justice ACT (EAJA). If we win your case, the government will pay the fees. In 1980, the EAJA was enacted for the purpose of creating an exception for how Attorneys are paid at the Federal level of appeals. What is CAVC?

The CAVC is a separate Federal Court established in 1988 with the Veterans’ Review Act under Article I of the US Constitution. Before the CAVC, the VA was the only administrative agency that had no judicial oversight. The CAVC is not part of the Veterans Administration, and it is a separate Federal Court of Appeals. Judges serving on the CAVC are independent and do not work for the Veterans Administration. When a case is not successful before the Board of Veterans’ Appeals (BVA), filers are given 120 days from the mailing date of the Board’s decision to appeal to the CAVC. Many filers have multiple options and avenues to choose from instead of a CAVC claim, including a supplemental claim or filing a new claim, so it’s important to review all your options to ensure you are making the right choice for your situation. Often, the decision by the CAVC is to address mistakes made by the BVA and remand the case back to the BVA to correctly analyze the case with the remand instructions. 

What Do You Need to Know About Filing a CAVC Claim?

As a result of Covid-19, there have been recent changes in how (CAVC) conducts hearings and reviews cases.  The Court is located at 625 Indiana Avenue, NW, Suite 900, Washington, D.C. 20004-2950. Since Covid, most cases filed before the CAVC do not require the Veteran to travel anywhere since the cases can be done remotely. The Court’s website specifically noted how the CAVC personnel have been working in a mix of remote and on-site locations and conducting oral arguments in-person (judges and counsel all present), virtually (judges and counsel all remotely), or in a hybrid environment where judges and counsel have the option of appearing in person or remotely.
